The basis on which you may use this website and the general terms applying to our recruitment and staffing services for clients and candidates.

1. About these terms

These terms and conditions govern your use of this website and the general basis on which Fabu Group provides recruitment and staffing services to clients and candidates.

2. Website use

You may use this website for lawful purposes only. You must not misuse it, attempt to gain unauthorised access, introduce malicious code, scrape content, or use it in a way that could damage or impair the site or another user's use of it.

We aim to keep the website available and accurate but we do not guarantee uninterrupted availability, and content may be updated or withdrawn at any time.

Information on the website, including salary guidance, is provided for general information only and does not constitute advice.

3. Recruitment services

We provide introductions of candidates to clients for permanent, fixed term, temporary and part time positions in private households, family offices, estates, businesses, hospitality settings, nurseries, schools, care homes and other organisations.

We act as an employment agency in respect of permanent placements and, where applicable, as an employment business in respect of temporary placements, within the meaning of the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003.

We never charge candidates a fee for finding or seeking to find work.

4. Clients

Clients are responsible for satisfying themselves as to the suitability of any candidate introduced, for conducting their own interviews, and for completing any checks they consider necessary before making an offer.

Clients remain responsible for compliance with employment law obligations relating to any person they engage, including right to work verification, contracts of employment, pay, working time, tax and national insurance, insurance, and health and safety.

Client requirements, candidate details and salary information exchanged with us are confidential and must not be passed to third parties without our written consent.

5. Candidates

Registering with us or applying for a vacancy does not create an offer of employment or a guarantee of placement.

Candidates must hold the right to work in the country of the role, hold any qualifications, licences or clearances they claim, and inform us promptly of any change in circumstances or availability.

Candidates agree that we may share their CV and details with prospective clients in connection with roles discussed with them.

6. Vacancies

Vacancies shown on this website are indicative and may be filled, amended or withdrawn without notice. Salary ranges, locations and start dates are guidance only and are subject to agreement between the client and the candidate.

We take reasonable care to describe roles accurately but rely on information provided by clients.

7. Introductions and placements

An introduction occurs when we provide a client with a candidate's CV or details, or arrange a meeting or interview.

An introduction fee becomes payable where a client, or any associated household, family office or organisation, engages an introduced candidate in any capacity within the period stated in our terms of business, whether or not through us.

Clients must notify us promptly when an introduced candidate is engaged, and must not pass a candidate's details to a third party. Where such an onward introduction results in an engagement, the introducing client remains liable for the fee.

8. Fees and payment

Fees, rebate or replacement arrangements, temporary placement rates, and any retained or search fees are set out in our written terms of business agreed with each client before an introduction is made.

Unless stated otherwise, invoices are payable within the period set out in those terms, fees are exclusive of VAT, and late payment may attract statutory interest.

9. Candidate information and accuracy

We take reasonable steps to verify candidate information, including obtaining references and confirming qualifications where appropriate, but we rely on information supplied by candidates and third parties.

We do not warrant the accuracy or completeness of candidate information, and clients should carry out their own checks, including DBS or overseas equivalents where the role involves children or vulnerable adults.

Any information you supply to us must be accurate, current and not misleading.

10. Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of reputation, or losses arising from the acts, omissions or conduct of any candidate or client.

Subject to the above, our total liability in connection with any introduction is limited to the fees paid to us in respect of that introduction.

11. Intellectual property

All content on this website, including text, photography, graphics, the Fabu Group name and logo, and the design and arrangement of the site, is owned by us or licensed to us and is protected by intellectual property law.

You may view and print pages for your own personal or internal business use. You may not reproduce, republish, distribute or commercially exploit any part of the site without our prior written consent.

12. Privacy

Personal information submitted through this website is handled in accordance with our Privacy Policy, which explains how we collect, use, share, retain and protect candidate and client data under the UK GDPR.

13. Governing law and jurisdiction

These terms and any dispute or claim arising out of them, including non contractual disputes, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
